Rescue ship Sea Watch 3 Captain Carola Rackete was heard by the public prosecutor in Agrigento on Monday, days after her arrest after she maneuvered her vessel into the Italian port of Lampedusa despite the ban from Italian authorities on Friday.
The hearing was held to determine whether Rackete should be held under house arrest, or be released as the investigation continues.
Public prosecutor... Еще Luigi Patronaggio said the validation hearing was held in a cooperative atmosphere.
«The public prosecutor's office asked for the confirmation of the arrest carried by the fiscal police, regarding the 1100 article of Navigation code, namely, resistance and violent acts against a warship,» he stated, while speaking at a press conference.
After the three hour of hearing, Patronaggio dismissed the «state of necessity» for the Sea Watch manoeuvre, and concluded Rackete deliberately clashed with the police motorboat.
The Prosecutor's Office also asked for a ban of residence in Agrigento's province, with the judge's decision expected on Tuesday.
«There are no detention measures so we assume that tomorrow she'll be free. We have to understand if the judge wants to apply or not this residence ban,» said Rackete's lawyer Alessandro Gamberini.
«I'm not currently expecting an expulsion, so our Minister will have to contain his rage,» he added.
Rackete is charged with resistance and violence against warship and attempted shipwreck.
